General Terms and Conditions

These terms govern all contracts concluded through waldart.co between Waldart GmbH, Grünstraße 12, 1010 Wien, Austria (“Waldart”, “we”) and customers. Version of 12 June 2026.

1. Scope

1.1 These General Terms and Conditions (“Terms”) apply to all orders placed through the online shop at waldart.co. Deviating terms of the customer do not apply unless we have expressly agreed to them in writing.

1.2 “Consumer” means any natural person acting for purposes outside their trade or profession (§ 1 KSchG). Provisions marked as consumer provisions apply only to consumers.

2. Conclusion of contract

2.1 The presentation of products in the online shop does not constitute a binding offer but an invitation to place an order.

2.2 By clicking the order button labelled “Buy now — obligation to pay” (or its equivalent in the selected language), the customer places a binding offer to purchase the goods in the cart (§ 8 FAGG).

2.3 The contract is concluded when we accept the order by sending an order confirmation by email. An automatic acknowledgement of receipt does not constitute acceptance unless it simultaneously confirms the order.

2.4 The contract languages are English, German, Croatian and Slovenian. In case of discrepancies between language versions of these Terms, the German version prevails.

3. Prices and payment

3.1 All prices are total prices in euros and include statutory value-added tax. Shipping costs are shown separately before the order is placed.

3.2 We accept the payment methods displayed at checkout (credit/debit cards, Apple Pay, Google Pay, Klarna, SEPA via Stripe; PayPal). The purchase price is due upon conclusion of the contract.

3.3 Payment processing is performed by Stripe Payments Europe, Ltd. and PayPal (Europe) S.à r.l. et Cie, S.C.A.; we do not store payment card data.

4. Production and delivery

4.1 Each piece is handcrafted to order. Unless stated otherwise on the product page, the production and dispatch time is approximately 10 business days from receipt of payment, plus transit time.

4.2 We deliver within the European Union. Shipping costs: Austria and Germany € 9.90; other EU member states € 14.90; free standard shipping for orders of € 150 or more.

4.3 For consumers, the risk of loss or damage passes upon delivery of the goods to the consumer or a third party designated by the consumer (§ 7b KSchG).

5. Retention of title

The goods remain our property until full payment of the purchase price.

6. Right of withdrawal (consumers)

6.1 Consumers have a statutory right to withdraw from the contract within 14 days without giving reasons, as set out in our Returns Policy / Withdrawal Instructions, which include the statutory model withdrawal form.

6.2 Exception: the right of withdrawal does not apply to goods made to the customer's specifications or clearly personalized (§ 18 Abs. 1 Z 3 FAGG) — in particular commissioned pieces, custom dimensions, moss logos and moss walls produced to individual specification. We point this out again before any such order is placed.

7. Statutory warranty

7.1 The statutory warranty (Gewährleistung) applies. For consumers, the warranty period for movable goods is two years from delivery (§§ 922 ff ABGB, VGG).

7.2 Natural variations in color, structure and texture of preserved moss are characteristics of the natural material and do not constitute defects, provided the piece substantially corresponds to the presentation in the shop.

8. Voluntary 5-year guarantee

8.1 In addition to (and without limiting) the statutory warranty, we grant a voluntary guarantee of five years from delivery on collection pieces: if the preserved moss substantially loses its shape or color under proper conditions of use, we will repair the piece or deliver a replacement at our choice, free of charge.

8.2 Proper conditions of use: indoor placement, relative humidity approx. 40–60 %, no direct sunlight, no water contact, no frequent touching. The guarantee does not cover damage caused by improper use, modifications or external influences. Guarantor: Waldart GmbH, Grünstraße 12, 1010 Wien; claims via office@waldart.co with proof of purchase.

9. Liability

9.1 We are liable without limitation for damage caused intentionally or by gross negligence, and for personal injury.

9.2 For slight negligence, liability for material damage and financial loss is excluded; this exclusion does not apply to consumers to the extent it would be inconsistent with mandatory law (KSchG).

10. Product safety information

Manufacturer within the meaning of Regulation (EU) 2023/988 (GPSR): Waldart GmbH, Grünstraße 12, 1010 Wien, Austria, office@waldart.co. Preserved moss is a decorative product for indoor use; it is not a toy, is not fire-rated unless expressly stated, and should not be installed directly above open flames or heat sources.

11. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 19 AStG). Consumers may also address complaints to the European Consumer Centre network.

12. Final provisions

12.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in another EU member state, the mandatory consumer-protection provisions of that state remain unaffected (Art. 6 Rome I Regulation).

12.2 If individual provisions of these Terms are invalid, the validity of the remaining provisions remains unaffected.
